03 — DIGITAL IDENTIFICATION
Before accepting a reservation or receiving transaction funds, the purchaser may be required to complete the applicable identity and compliance procedures.
Depending on the purchaser and transaction, this may include:
• Passport or national identity document.
• NIE or other applicable identification.
• Residential address.
• Corporate documentation where applicable.
• Identification of directors or authorised representatives.
• Identification of the ultimate beneficial owner.
• Source-of-funds information where legally required.
• Additional compliance information where required by applicable legislation.

04 — LEGAL & PROPERTY DUE DILIGENCE

05 — RESERVE THE PROPERTY ONLINE
The property can be secured remotely.
Where the property and seller permit an online reservation, we will provide a Reservation Agreement setting out the applicable terms.
The reservation documentation will identify, among other matters:
• The property.
• The agreed reservation period.
• The purchase price or agreed commercial terms.
• The reservation amount.
• The payment method.
• The conditions of the reservation.
• The circumstances governing refund or forfeiture of the reservation amount.
• Any conditions precedent.
• The obligations of the purchaser and seller.
The purchaser may review the documentation electronically and, where legally appropriate, sign it using an electronic signature system capable of evidencing the identity of the signatory, the document integrity and the signing event.
Once the applicable agreement has been duly executed and the required reservation funds have been received and verified, the property will be treated as reserved in accordance with the terms of that agreement.
This is not merely an enquiry. It is the formal beginning of the acquisition process.

06 — SECURE PAYMENT
For high-value transactions, payment instructions will be issued through the agreed contractual and banking channels.
Payments must be made through traceable and legally acceptable means.

Where required, the transaction may involve the purchaser’s bank, lawyer, tax adviser, notary or other regulated professional.
Payment arrangements will always be established specifically for the transaction before funds are transferred.

07 — FROM RESERVATION TO PURCHASE
Once the property has been reserved, the parties may proceed to the definitive contractual stage.
Depending on the transaction, this may involve:
Reservation Agreement → Private Purchase Agreement / Deposit Agreement → Public Notarial Deed → Registration
The precise sequence depends on the property, seller, purchaser and agreed contractual structure.
The purchaser may appoint an independent Spanish lawyer to conduct or supervise the legal process.

08 — BUY WITHOUT TRAVELLING TO SPAIN
Your presence may not be necessary.
International purchasers can, where legally and practically appropriate, complete significant parts of the acquisition process remotely.
Documentation may be exchanged electronically and certain notarial procedures and powers of representation can be handled through the Spanish notarial electronic infrastructure. The Spanish Notariat operates an electronic platform through which authorised notarial services and documents can be managed securely. (Notariado)
Where personal attendance at completion is not required, the purchaser may appoint an appropriately authorised representative through a Power of Attorney.
A notarial power of attorney is a public document allowing an appointed representative to act on behalf of the purchaser within the powers granted. Authorised electronic copies can be transmitted between notaries. (Notariado)
This can allow the purchaser to remain abroad while the acquisition is completed in Spain, subject to the requirements of the particular transaction.

09 — NOTARIAL COMPLETION
Where the transaction proceeds to a public deed, the relevant parties or their duly authorised representatives appear before the Spanish Notary.
The Notary verifies the identity, capacity and authority of the parties and performs the legally required checks concerning the transaction.

The purchase price, payment arrangements and other relevant contractual matters are recorded in the public deed.

10 — REGISTRATION
Following completion, the acquisition can be submitted to the relevant Land Registry.
